Starting in 2019, our office has been providing assisted reproduction services. Surrogacy Center Agreements

The journey through surrogacy can at times be long, costly, and complicated. Here at the Bay Area Family Law Center, we assist intended Parents (Ips), looking to sign with a surrogacy center, with review and or drafting of the legal agreement between the surrogacy center and your family. During this process, we can assist your family in negotiating the surrogacy center terms and provisions to ensure that your surrogacy center does more than just matching you with a surrogate and collect a hefty paycheck for this sole service. We strive to ensure that the surrogacy contracts ensure that surrogates are vetted appropriately and that the centers help coordinate your journey from matching you with a surrogate meeting your needs through the birth of your newborn.

Agreements Between Intended parents (IPs) and Surrogates

Once you have found your surrogate, our attorneys are happy to take the reins in helping to formulate your ideal surrogacy agreement. Our Surrogacy Agreements will include terms which:

  • Establish you as the rightful legal guardian of your newborn.
  • Set forth the terms and conditions of your surrogate’s compensation.
  • Addresses issues of health insurance and the variety of insurance policies applicable to surrogacy.
  • Set forth whether you do a single embryo transfer or a double embro transfer.

Embryo Donation

Bay Area Family Law Center drafts and reviews Embryo Donation Agreements for those seeking to receive embryos as part of their family planning as well as for those seeking to donate embryos. Our attorneys ensure that your embryo donation contract ensures that parentage rights are clearly defined. We ensure that only the intended parents shall have rights to the newborn, while ensuring that the embryo donor(s) do not become parents unintentionally. At the end of surrogacy, Intended Parents often have remaining embryos which can be donated to other families, to scientific research, or discarded. If it is your desire to donate your embryos or to receive donated embryos, are attorneys are here to help.

Parentage Actions and Prebirth Orders

As you prepare to welcome your newborn into your life, most families desire to ensure that the Intended Parents are listed on the birth certificate from the outset of life. In California, Prebirth Orders are permitted as a part of a Parentage Action, allowing you to ensure that your child’s birth certificate certifies you (including your spouse) as the parent(s) of your newborn. In all California cases, we are happy to help you with your Parentage Action to ensure that you are the legal guardian of your child.
